Shia LaBeouf will not be charged with a DUI from his July car accident, but his license could be suspended for refusing a breathalyzer test.

The L.A. County District Attorney had "insufficient evidence" to charge Shia, but he must now appear at a traffic hearing at the Department of Motor Vehicles on Friday. His license could be suspended for up to nine months.

"Shia is most happy that he will not have to go to court," his attorney, Michael Norris, told the AP. "I anticipate that once we do have the opportunity to litigate the matter at the DMV that his license will not be suspended."

Shia has gone back to work on Transformers 2 and his injury has been written into the movie. He told Entertainment Tonight, "It was one of the biggest things that's happened to me, for sure, in my life," he added. "I'm grateful to be here."

Megan Fox may not be in the movie Eagle Eye, but there's no reason why she can't turn up to show up to support her former co-star Shia Labeouf, who I'm sure had no complaints about her red carpet presence.

Shia was joined by many lovely ladies last night at the premiere of his new movie Eagle Eye. Co-starring Michelle Monaghan, Eagle Eye is a thriller about what happens when two strangers are thrown together after a secret terrorist group tries to make them part of their cell; the two characters' every move is tracked by modern technology and they become fugitives from the law while at the same time trying to outr un this mysterious enemy.  Sounds intriguing, don't it?

J/k, Shia is fine.  We spotted the dirty but sexy star on the set of Transformers 2; even though Shia's torn shirt and bloody face are fake, the cast is still real.  Aww, we hope you get well soon!

      

We knew Shia LaBeouf wouldn't let a little hand injury slow him down.  We spotted the actor (along with his stunt double) on the set of Transformers 2 yesterday, with his cast on so it looks like his injury has been written into the movie.  Shia will be reprising his role as Sam Witwicky but he looks like he has a new co-star; all new 2010 Chevrolet Camaro!  Transfomers: Revenge of the Fallen is slated for release on June 26, 2009.

        

Even though Shia LaBeouf still has that intense cast on his hand and arm, he's managing to get around.  Check out Shia as he sips his bottle Arizona iced tea and wanders around his California neighborhood.

Shia LaBeouf's lawyers are now saying that the actor's hand was "crushed" in the car accident he was involved with last week.  We found Shia relaxing outside his Los Angeles hospital on a smoke break with his left hand and arm in a cast (and blood stains on his jeans) but Shia could still face complications. Shia's attorney Michael Norris released a statement saying, "His doctors remain hopeful that he will fully recover, but due to extensive surgery and the nature of the injuries, there remains a substantial risk of both infection and other complications."
Shia's injury will delay the filming of Transformers 2 however it will probably be written into the script.

      

We spotted Shia LaBeouf's mom Shayna leaving a pharmacy in Los Angeles yesterday, was she picking up some meds for her son who suffered hand and head injuries after a car accident over the weekend?

Although Shia will be cited with a DUI it has been reveled that the accident wasn't his fault.  The police are now saying that the other car involved ran a red light and caused the collision. The other passenger of the truck has been identified as Shia's Transformers 2 co-star Isabel Lucas.  Shia's mom says he is doing "fine" and has visited him at the hospital.

   

Shia LaBeouf was arrested very early Sunday morning on DUI charges after being involved in a car accident that flipped his truck.  The actor and his female passenger were driving through Hollywood at about 3am when the collision occurred.  Because no one at the scene was seriously injured, Shia was charged with a misdemeanor DUI however Shia did have to have extensive hand surgery which will delay shooting of his next movie, Transformers 2, by two months.

Shia LaBeouf has come a long way since his days on the Disney channel.  Who could forget Shia as the precocious and comic Louis Stevens, a role that won him a daytime Emmy award .  Well these days sexy Shia is rolling with Harrison Ford and is staring along side him in the fourth Indiana Jones movie The Kingdom of the Crystal Skull.  We caught up with him outside of the The Late Show with David Letterman where looked dapper in a dark suit and stopped to sign some memorabilia for fans. 

   

Oh Shia, you don't seem like a bad ass, but you just keep getting yourself in trouble!  Shia was arrested for criminal trespassing back in November when he was drunk and refused to leave a Walgreens, then just this month he received a ticket for unlawful smoking in California which lead to a warrant when he didn't show up for court! The trespassing and the smoking issues have been cleared up, but yesterday during a photo shoot, Shia got his car impounded!
